Contractual agreement with the outsourcing company


Contracts with the Outsourcing Partner

We can propose to sign the offshore contract with Outsourcing Advantage, with our offshore partners, or with the offshore company of your choice.

 Offshore development agreement signed with Outsourcing Advantage

If you choose to sign the offshore development agreement with our company, we choose together the company that you want to use for your offshore realizations. That offshore company is naturally stated in our agreement.

Outsourcing Advantage subcontracts, using a predefined and strong agreement, the realizations for you with the chosen company and guarantees the risk of the project.

The pricing of the offshore services will be the same as if you signed directly with the offshore company. The Offshore Company will not charge an additional margin.

Outsourcing Advantage will propose a series of services to accompany the offshore project that you are free to accept or reject.

 Agreement with the offshore company

There is no standard contract for all project types.

Contracts should be carefully crafted for our customer to feel at ease with the easy we are working together.

Our experience shows that simple contracts defining the framework of the relationship are essential for a successful cooperation.

The contract must clearly define:

- Project management organization: Who is responsible for what in the project? who provides the specifications? How changes are managed?
- Deliverables definition: What is delivered? How acceptance is defined? What means are deployed offshore to check acceptance before delivery?
- Hardware and software: Who provides hardware and software licenses? What hardware and software requirements are needed? Is it feasible?
- Fees definition: How are the fees calculated? Is there any ambiguity in the fees calculation? Is the fees calculation easy to perform in the future? Is it sound to use penalties? How to maintain pressure on the offshore team?
- Team: How is the team built? How the team can be expanded or reduced? How is the team quality assessed? If you don't keep a permanent team, do you wish to have access to the same people when you start a new project?
- Ownership and security: Ensure that the ownership of the software is clearly defined in the contract. Check whether the security enforced offshore is acceptable to you.
- Communications: How is communication ensured? Who pays for communications fees? Is the communication structure adequate? What common language is used between project members?
- Extra costs: Are there extra costs? Is something needed that is not anticipated?
- Documentation: Should the product come with technical documentation? Should it include information for user's documentation? How is online help installed?
- What happens in case of client's insatisfaction?
- Non payment: What are the effect of your non payment or late payments?
- Contract termination: When can it happen. What is the notice period? How confidential elements are processed?

Of course, all these conditions should be discussed and defined with you to suit your expectations and your needs.
